These terms are the agreement between you and the operator of HaFa ("HaFa", "we", "us") for using the HaFa app and the services that come with it: messages, voice and video calls, status updates, the wallet and payments, shops, deliveries, promotions and the hafa.chat website (together, "HaFa"). By creating an account or using HaFa, you agree to these terms, to the Privacy Policy and to the Refund Policy.
1. Who can use HaFa
- You must be at least 13 years old to use HaFa, or older if your country sets a higher age for using a service like this without a parent's consent.
- You must be at least 18 years old, and legally able to enter a contract, to use the wallet, payments, identity verification, shops, promotions, or to deliver as a rider.
- You may not use HaFa if you are barred by law from doing so, including under sanctions that apply to us or to you.
- Some features, especially money features, are available only in some countries, in some currencies, or after you verify your identity.
2. Your account
- Your account is your phone number, confirmed with a one-time code. Keep your phone, your screen lock and your wallet PIN safe; anyone who has them may be able to use your account.
- Your @tag is yours for as long as you have your account and cannot be changed. It is never given to anyone else, even after you leave. We may take back a tag that impersonates someone, infringes a trademark or breaks these terms.
- Tell us straight away if you think someone else has used your account or your wallet.
- If you change your number, use Change number in the app. If you stop using a number, it may be given to someone else by your mobile network; your HaFa account stays tied to your phone's keys, not to the SIM.
3. Privacy and encryption
Messages, calls, status updates, media and shared live locations are end-to-end encrypted. We cannot read or listen to them, so we cannot recover them if you lose them. The Privacy Policy explains what information we do handle and how.
4. Using HaFa responsibly
You agree not to use HaFa to:
- break the law, or help anyone else break it;
- send spam, bulk or automated messages, or messages people have not asked for;
- harass, threaten, bully or intimidate anyone, or share someone's private information or intimate images without their consent;
- share content that sexually exploits or endangers children;
- promote violence, terrorism or hatred against people for who they are;
- defraud people, including fake payment requests, fake receipts, phishing, or pretending to be someone else, including HaFa staff;
- launder money, finance terrorism, evade sanctions, or send money connected with illegal activity;
- sell or advertise anything illegal or on HaFa's prohibited goods list (published in the app);
- spread malware, or interfere with, overload, reverse engineer or get around the security of HaFa, other than as the law expressly allows;
- create accounts by automated means, or use HaFa on behalf of someone who has been removed from it.
You are responsible for what you send and share. You keep ownership of your content. So that we can deliver it, you give us a limited, worldwide, royalty-free permission to store, carry and display your content only as needed to run HaFa for you. For public content (such as a published shop catalogue or a promotion), that permission includes showing it to the public on HaFa and hafa.chat until you remove it.
5. Reports and enforcement
You can report abuse, a contact, a shop or a product to us through Help in the app. Because conversations are end-to-end encrypted, we can only see messages that you choose to send us as part of a report. We may review public content such as shop catalogues and promotions at any time, and products that several people report may be hidden while we review them.
If you break these terms, or we must act to protect people, HaFa or the law, we may warn you, remove content, limit features, hold money while we investigate (as the law allows), or suspend or close your account. Where we can, we will tell you why and give you a way to appeal through Help in the app. We may report illegal activity to the authorities.
6. Money
6.1 Who provides the money services. HaFa's wallet and payments are provided with licensed payment partners, banks and mobile-money operators in each country. Where a partner holds your money, it does so under its own licence and terms, which you also agree to when you use the service. HaFa is not a bank, and your balance is not a bank deposit. Where a feature is shown in the app as a demo, demo balances and payments have no cash value and cannot be withdrawn.
6.2 Verification and limits. We must know who you are before you can send or hold money above small amounts. How you verify depends on your country. We set limits on how much you can send, receive and hold, by country, by verification level and by how secure your phone is. We may ask for more information, delay a payment to check it, or refuse a payment, where the law or our risk checks require it.
6.3 Your currency. Your wallet uses the currency of the country you signed up in, unless you change it in the app (at most once every 30 days). Payments into another currency are converted at the rate shown before you confirm.
6.4 Fees. Any fee is shown before you confirm a payment. We do not charge fees that were not shown to you. Your mobile network may charge you for data and SMS.
6.5 Sending money. You are responsible for choosing the right person. Check the name and @tag before you confirm. Once a payment to another HaFa user is completed, it is final and cannot be cancelled, except as described in the Refund Policy (mistakes by us, fraud, or payments you did not authorise).
6.6 Offline payments. Payments made over Bluetooth without a network are promises that settle when either phone reconnects. They are capped at a small daily amount, only between wallets in the same currency, and they can fail to settle, for example if the sender no longer has the money or the voucher is more than 10 days old. Do not hand over goods for an offline payment you cannot afford to lose.
6.7 Gifts and requests. A money gift that is not opened within 24 hours goes back to the sender. Payment requests expire after the time shown.
6.8 Airtime, bills and agents. Airtime, data and bill payments are passed on to the provider you choose; once the provider accepts them, the provider is responsible for delivery. Cash deposits and withdrawals with an agent are between you and the agent, recorded in your wallet.
6.9 Payment links and receipts. A payment link or QR code says whose wallet the money goes to and, where given, in which currency. A verified-payment page on hafa.chat shows whether a payment reference is real. Never accept a screenshot as proof of payment; check it in the app.
6.10 Tax. You are responsible for any tax on money you receive or on sales you make.
7. Shops, orders and deliveries
- A sale in a HaFa shop is a contract between the buyer and the seller. HaFa is not the seller, does not own or inspect the goods, and is not responsible for their quality, safety, legality or delivery. Sellers are responsible for their listings, prices, stock, taxes, returns and following consumer law.
- Only verified businesses can publish a catalogue. We may remove listings, and videos may be reviewed before they are shown.
- Riders are independent. HaFa vets riders before they can be assigned orders, but a delivery is arranged between the seller, the rider and the buyer.
- If something goes wrong with an order, talk to the seller first. If that does not solve it, HaFa will help as described in the Refund Policy.
8. Promotions
Verified businesses can pay to show offers to people nearby. You pay in advance from your wallet; you are charged only for offers actually shown, and unspent budget is returned as described in the Refund Policy. Promotions must be truthful, legal and follow our advertising rules; we review them and may refuse or stop any promotion.
9. Calls and emergencies
HaFa is not a replacement for your phone's calling service and cannot be used to call emergency services. Calls need a working internet connection or network and may not connect. In an emergency, use your phone's dialler.
10. Nearby and Bluetooth
Nearby mode passes sealed messages through other people's phones and theirs through yours. It is best effort: messages may arrive late or not at all. It uses your phone's battery and Bluetooth, and announces your @tag to phones close by while it is on.
11. Third-party services
Some features rely on services we do not control, such as mobile networks, app stores, maps, payment partners and Google's notification service. Their terms may also apply, and we are not responsible for their availability.
12. HaFa's software and brand
HaFa, its app, website, logo and design belong to us or our licensors. We give you a personal, non-transferable, revocable licence to use the app as intended. HaFa includes open-source software, which is used under its own licences.
13. Availability and changes
We work to keep HaFa running, but it may sometimes be unavailable, and features may change or be withdrawn. We will give reasonable notice of changes that significantly affect you, unless we must act sooner for security or legal reasons.
14. Leaving HaFa
You can stop using HaFa at any time and ask us to delete your account through Help in the app. Withdraw your wallet balance first where the app lets you; money you are owed is still yours after you leave, and we will return it as the law requires. We may close an account that has been inactive for a long time after warning you, or as described in section 5.
15. Disclaimers
HaFa is provided "as is" and "as available". To the extent the law allows, we do not promise that it will always be uninterrupted, error-free or suitable for a particular purpose. Nothing in these terms takes away rights you have under consumer law that cannot be excluded.
16. Our liability
Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud. Subject to that, and to the extent the law allows:
- we are not liable for losses that were not reasonably foreseeable, for indirect losses, or for loss of profits, business or data that you could have backed up;
- we are not liable for goods and services bought from sellers on HaFa, or for the acts of other users, riders or third-party providers;
- our total liability to you for any claim is limited to the greater of the fees you paid us in the 12 months before the claim and 100 US dollars (or its equivalent in your currency).
This does not limit what we owe you for payments we processed incorrectly or that you did not authorise, as set out in the Refund Policy and required by law.
17. Indemnity
If you are using HaFa for a business, you agree to cover our reasonable losses and costs arising from your breach of these terms or of the law, or from claims by your customers about your goods or services.
18. Law and disputes
These terms are governed by the law of the country where HaFa's operator is registered. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you can bring a claim in your local courts. Before going to court, please contact us so we can try to solve the problem.
19. Changes to these terms
We may update these terms. We will show the new effective date and, for important changes, tell you in the app before they take effect. If you keep using HaFa after that, the new terms apply. If you do not agree, you can stop using HaFa and close your account.
20. General
If any part of these terms cannot be enforced, the rest still applies. If we do not enforce a term straight away, we can still enforce it later. You may not transfer your account or these terms to anyone else; we may transfer them to a company that takes over HaFa, with notice to you. These terms, the Privacy Policy and the Refund Policy are the whole agreement between us about HaFa.
